Give them the variance.... a.k.a. give them the Non profit low income housing builder treatment which is basically ask and you shall receive. This is the least we can do to welcome a new bizz into the city. Let's just hope they are on good terms with abutters.
WTH is the big deal !!! These variances are routinely granted. I'd be curious to know if an entire wall is in violation or is there a drive-thru or loading dock something like that, that is projecting too far into teh set back. I also have to wonder if this is possibly an interpretation issue.... i.e. Code dept. says is in violation and Price Rite says no it isnt.
If it is in fact a set back problem, I see them getting it no problem. The problem is if they just found out now it will take about two months from start to finish to get variance and the occupancy permit.
