After reading the article it sounds to me like Pace is just trying to survive. I'm not a lawyer but I don't think Direct Air has anything to worry about. I would be very surprised if a judge ruled in the favor of Pace especially considering they reneged on the type of aircraft.
On the other hand, it was nice to see that August was Direct Air's 2nd busiest month ever with 9.1% of Myrtle Beach airport’s incoming traffic. Although I would love to see more carriers at Worcester airport, sooner rather than later, I think Direct Air may have staying power in Central New England at our “beloved” airport.
Sorry for changing the subject but I quickly want to comment on an earlier post about the 10th birthday bash of the Worcester Cultural Coalition. The poster told you Bill that they could get tickets for you and it was going to be held at the new BBQ restaurant (Bones BBQ & Blues) at the Hadley Building. Is the Niche Hospitality group building this out now? Does the rumor mill confirm that they are still planning on opening Bones?
The reason I ask is that an email I received this morning states that the birthday bash will indeed be held at the Hadley Building but in new gallery space called GArtH – Gallery of Art at the Hadley.

No more Pace listed. Now with them dropping Pace and Virgin America, do you think they might lease someof JetBlue's planes again?!

The outcome will surely depend on the wording of the contract.
If the judge feels Direct Air was not justified in canceling the contract, Pace will win, and Direct Air will probably be shut down.
This dispute could shut them down with legal fees alone.

Anyone know why Sunday's flight from Punta Gorda was diverted to Hartford? Weather didn't seem all that bad.

If the plane wasn't the right plane, you refuse it. You cannot use a plane for eight weeks and then say "Oh, it wasn't a 737-500 like we asked for". Since Pace is bankrupt, the judge has to recover all of the value for the business. It is likely that Direct Air will have to pay or fold.
